5.1 Ownership

All content, features, functionality, branding, and materials available through the Service - including but not limited to text, graphics, logos, design elements, software, and methodologies - are the exclusive property of Anavolur or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business purposes in accordance with this Agreement. This licence does not permit you to sublicense, modify, distribute, or create derivative works based on any part of the Service.

By submitting any Content to the Service, you grant us a worldwide, royalty-free, non-exclusive licence to use, store, process, and display that Content solely as necessary to provide the Service to you. Our total cumulative liability to you for any claims arising under this Agreement shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim, or one hundred euros (€100), whichever is greater.

Some jurisdictions do not permit the exclusion or limitation of certain damages. In such cases, our liability shall be limited to the minimum extent permitted by applicable law.

This Agreement shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which Anavolur operates, without regard to its conflict of law principles.

In the event of any dispute arising from or relating to this Agreement or your use of the Service, both parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within thirty (30) days, either party may pursue available legal remedies.

Nothing in this section limits your statutory rights as a consumer where such rights cannot be contractually waived.

This Agreement, together with any supplementary policies or documents expressly incorporated herein, constitutes the entire agreement between you and Anavolur with respect to the Service and supersedes all prior or contemporaneous communications, representations, and agreements, whether written or oral.

Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Anavolur to be effective.
